System Surveyor, Inc., a Delaware corporation (the “Company,” “we,” “us” or “our”), provides and maintains this web site and one or more related mobile applications (collectively, the “Site”) to provide an internet-based subscription software service to registered users (the “Service”). We are committed to diligently protecting the privacy of personal information, so we may periodically update this Privacy Policy to reflect new personal information practices, when we adopt new privacy policies and in any other circumstances when it seems appropriate to do so. We do not knowingly attempt to solicit or receive information from children.

This Privacy Policy describes the types of personal and non-personal information collected by us and describes how we use such information and to whom and under what circumstances we may disclose it. By registering as a user of our Service, or by accessing and using the Site or the Services, you agree to the collection, use and disclosure of your information as described in this privacy policy. IF YOU DO NOT WISH TO BE BOUND BY THIS PRIVACY POLICY, YOU MAY NOT REGISTER AS A USER, OR ACCESS OR USE THE SITE OR THE SERVICES.

Information We Collect and Information Provided by You.

We collect personal and business information that you provide us through the Site or the Services, or through other means such as email or online interactive forums. The information we collect from you will generally include your name, email address, address, phone number, company name, job title, photos, and information about your company, your company’s clients or potential clients, or other business associates. In some cases, you may provide log in IDs and passwords or cost information related to system assets represented in our Service. When inviting other persons or businesses to view the content you have provided to the Service, you will share their names and email addresses with us as well. The information you provide may also include certain preferences that may be used to enhance your user experience, such as your preferences regarding products, services, technologies and manufacturers. When you register as a user and pay for the Services, you will provide us with your billing name and address, your credit card number and expiration date, and any other information required to process your payments. You can choose not to provide us with certain personal and company information, but then you may not be able to gain access to or full value of the features and benefits of our Site or Services.

Automatic Collection of Information.

Like many Web sites and mobile applications, we automatically track certain information about you as you use our Site and Services to help us manage our systems and deliver optimal user experience. This information may include, your IP address, the URLs and web pages you’ve visited along with frequency and duration of the visits, your geographic location, information accessed, and your browser type, operating system or mobile device information. 

We process this personal information to obtain information about our Site, engagement with our own and third-party content and interest in our products and services and to enable you to request information from us, to communicate with us and to be contacted by us. We do not and will not sell the personal information that we collect from you through this Site. 

We rely on fulfillment of contract and legitimate interest as the lawful basis under GDPR Article 6 for processing the personal information that we collect in this manner. We have a legitimate interest in understanding how our customers, potential customers and visitors use our website, which helps us better design our Service. 

Use of Cookies and Similar Technologies

The primary purpose for gathering personal and company information is for authorization and use within the Site and Services. We use information that we collect for the following general purposes: to improve your experience in using our Site and the Service and, in doing so, to enhance your personal and professional productivity; to communicate with you and other users regarding products, services and informational notices that we think may be of interest to you; to fulfill your requests for products and services, to customize the advertising and content you see; to contact you; and for administrative and internal business purposes.

We will not sell, rent, transfer or otherwise disclose your personal information to third parties except as provided in this Privacy Policy or as otherwise expressly authorized or directed by you. We may share anonymous information with third parties for any purpose. We may share personal information and the data we collect from and about you with third parties in the following instances: 

  • With our service providers, if the disclosure will enable them to process payments made by you using the Site or Services or otherwise perform a business, professional or technical support function for us or you; 
  • With your service providers, if you utilize our API’s for the exchange of your data; 
  • As necessary, if we believe that there has been a violation of the Site, the applicable terms of use or of our rights or the rights of any third party; 
  • As necessary, to identify, investigate, prevent or take action regarding illegal activities or suspected fraud or other abuse related to the Site; and

We work closely with certain affiliates and business partners with whom we may share general or aggregated statistical information. This aggregated, non-identifying information may include usage patterns, trends, preferences and other collective characteristics of our users and serves to help us, our affiliates and others evaluate and tailor our communications, advertisements, products, services and general business practices to provide greater benefit to our clients. 

From time to time we share aggregated, anonymized personal information we collect from you with trusted affiliates and business partners who work with or on behalf of us. These companies may use your personal information to enhance and personalize your experience with us, to communicate with you about services, products and events that may be of interest to you and for other promotional purposes. Information sharing allows us to introduce new services, products and resources based on your interests and needs. With that in mind, your information may be shared with other select companies whose products and services you may find useful and those select companies will handle, store, retain, use, share and access personal information in accordance with their own privacy policies, and we disclaim any and all liability relating thereto. 

Every now and then, we may invite you to take part in surveys and promotions. The information we collect from these surveys and promotions may be matched with individual accounts to improve your overall experience and may be shared with select third parties. 

In addition, we reserve the right to disclose and transfer your information, including your personal information and anonymous information about you: (a) to a subsequent owner, co-owner or operator of the Site; or (b) in connection with a merger, consolidation, restructuring, the sale of all or substantially all of our equity ownership interests and/or assets or other corporate change, including during the course of any due diligence process. 

Opting Out of Information Sharing

We understand and respect that not all of our end users may want to allow us to share their information with other select companies. If you do not want us to share your information, please contact us at the email address referenced in the Contact Us section of this policy, and we will (as soon as reasonably practicable) take steps to ensure that we do not share your information with other companies (other than service providers that assist us in providing the Site and the Service). However, under the following circumstances, we may still be required to share your personal information:

  • If we respond to subpoenas, court orders or legal process, or if we need to establish or exercise our legal rights or defend against legal claims.

Authorized Third Parties

We may work with third party service providers to monitor certain pages of our Site for such purposes as reporting traffic and other statistics. Where authorized by us, these third-party providers may use cookies and/or other monitoring technologies to compile anonymous statistics about our visitors. No personally identifiable information is transferred to these third-party service providers. 

We may also allow third parties to provide us with analytics about your visits to our Site. From time to time, we may provide notices to you through email, postal mail, telephone solicitations, and/or in-person sales calls with information related to the Site or Services. Please be advised that should your information is disclosed to an affiliate, partner or service provider in accordance with this Privacy Policy, we do not provide a means of opting-out of any communications with that affiliate, partner or service provider may send to you and we advise that you contact such affiliate, partner or service provider directly for more information on any available opt-out procedures.

On-line Postings

We may from time to time provide on-line interactive forums such as bulletin boards, chat sessions and rooms, or message boards for users to receive or exchange information about products and various topics. Frequently, information disclosed in these areas may be viewed by other users of the Site. If you post on any on-line interactive forums, please use caution not to disclose any personal or company identifying information which may be sensitive or protected. You use these on-line interactive forums at your own risk and we are not responsible or liable for the uses that others may make of the information you post on any of these areas, even if such information is posted at interactive interface forums made available by the Company. 

Security

We use technology designed to protect user information and transmissions made within and among our web-based tools and mobile applications. The personal or company identifying information that you provide us is stored on servers and your personal or company mobile device. We will maintain appropriate organizational and technical measures for the protection of the security and integrity of user information. Our servers are located in secured facilities with restricted access and protected by protocols and procedures designed to ensure the security of such information. We highly recommend that you employ measures available on your computer and mobile device to secure your computer and mobile device against unauthorized access and use. No data transmission over the Internet can be guaranteed to be 100% secure. As a result, while we strive to protect user information, we cannot ensure or warrant the security of any information you transmit to or from the Site and Services, and you engage in such transmissions at your own risk. 

Third Party Sites

Our Site may provide links to third-party websites for your convenience and information. If you access those links, you will leave the Site. We do not control those sites or their privacy practices, which may differ from our privacy policy. We do not endorse or make any representations about third-party websites or any of the products or services advertised thereon. The personal data you choose to give to unrelated third parties is not covered by this privacy policy. We encourage you to review the privacy policy or any company before submitting your personal information. 

California Privacy Rights

We incorporate this section to identify additional consumer protections that are in accordance with California law.

When you access our Site, we may automatically collect personal information such as technical data about the device that you are using and your browsing patterns.  We collect this information by using cookies, server logs and similar technologies.  You may choose to give us additional personal information, such as your name, employer, address, email and telephone number.

We use this personal information in several ways, including monitoring website activity, gauging interest in our products and enabling you to communicate with us and request information.

We do not and will not sell the personal information that we collect from you through this website.

Exercising your rights. You may contact us to request a list of the categories of personal information that we collect and related information such as information sources, categories of information that we share with third parties and the purpose of any such sharing. These practices are also described in this Privacy Policy. 

We will not charge or penalize you for requesting information and otherwise exercising your rights as described in this Privacy Policy, but we may reasonably limit the number of requests you may make and impose appropriate charges as permitted by law. 

In some instances, you may request that we delete your personal information, consistent with your general right to request that we, as a business, delete any of your personal information that we have collected from you. Certain unique exceptions specifically preclude that we delete some information. Additional information is provided in this Privacy Policy. 

If you use an authorized agent to request information or exercise your rights, that authorized agent must meet the same authentication requirements that apply to the requests that we may receive directly from you. We may verify requests made by authorized agents to ensure security and comply with regulations and our internal policies. 

California’s “Do Not Track” Notice:

“Do Not Track” (“DNT”) is a preference you can set in your web browser to let the sites you visit know that you do not want them collecting information about you. Our Site does not currently respond to “Do Not Track” settings. For further details regarding DNT, visit donottrack.us.

Transferring Personal Information from the European Union to the United States.

Our headquarters is in the United States. Information we collect from you will be processed and stored in the United States. We have not sought nor have we received a finding of “adequacy” from the European Union under Article 45 of the GDPR. We rely on derogations for specific situations as set forth in Article 49 of the GDPR. We collect and transfer to the U.S. personal information only: with your consent, to perform a contract with you or pursuant to a compelling legitimate interest, which does not outweigh your rights and freedoms. We seek to take appropriate measures to protect the privacy and security of your personal information and to use it only consistent with your relationship with us and this Privacy Policy. We may also enter into data processing agreements and model clauses with our vendors.

You may also request that we refrain from using your personal information for direct marketing purposes. In many countries, you have a right to lodge a complaint with the appropriate data protection authority if you have concerns about how we process your personal information. When practicable, we will provide, at no cost and in response to your authentic request, your personal information to you or transmit it directly to another controller. If we cannot provide the requested information right away, we will let you know when it can be provided. If we deny your request, we will explain the basis for our decision. 

Children

Our Site and Services are designed and intended for a general professional audience and are not intended for children. We do not knowingly collect or use personal information regarding children under the age of 13. If we obtain actual knowledge that we have collected personal information about a child under the age of 13, that information will be deleted from our database.

Changes and Updates to this Privacy Policy

We may modify or amend this privacy policy from time to time and in our sole discretion. Use of information we collect now is subject to the Privacy Policy in effect at the time such information is collected. If we make changes in the way we use personal information, we will notify you by posting an amendment to the privacy policy on the website and you consent to notice of changes through such posting.
